polizia - Procedimethi contro agenti di polizia - Cifre non chiare
I. Procedimenti disciplinari against Brandenburg police officers, according to Interior Ministry data, have seen an uptick in recent years. Last year, 56 such proceedings were initiated, the ministry reported in a statement. In contrast, there were allegedly only 32 in 2020. However, a ministry spokesperson clarified that some of these proceedings may be dropped over time due to legally mandated disposal deadlines. "This disposal prohibition, which is legally regulated, allows for the removal of disciplinary proceedings from personnel files after specific timeframes, making them no longer searchable in retrospect," he elaborated. He did not provide an explanation as to why the numbers could not be accessed anonymously. A definitive trend, therefore, cannot be discerned for the employers - the Interior Ministry. In accordance with the State Disciplinary Law, references to disciplinary actions such as warnings, fines, wage reductions, and retirement benefits reductions are no longer considered after two years. Shorter deadlines apply for proceedings that were closed without disciplinary action.
II. If evidence suggests an administrative offense, a disciplinary proceeding can be initiated. At this stage, it is determined whether an error was indeed committed by the employee. "At this juncture, they remain suspicion cases, so no definitive statements can be made about the development of disciplinary proceedings," the spokesperson explained. Among the cases mentioned, some ongoing proceedings are being conducted. "We cannot make any statements about the accusation for data protection reasons," he added.
III. The Interior Ministry in Potsdam oversees disciplinary proceedings against Brandenburg police officers, as indicated in their recent statistics. Despite the increase in these proceedings in recent years, some cases may be dropped due to legally imposed disposal deadlines, as explained by a ministry spokesperson.
