Giustizia - Corte: Errore nell'nomina del Procuratore Generale
The currently open position at the Procura Fiscale in Erfurt remains vacant for now. The reason is a decision of the Tribunale Amministrativo in Gera, which found that the procedura di selezione of the Ministero della Giustizia Thuringia was "non giuridicamente solidissima," according to the President of the Tribunale Amministrativo in Gera, Michael Obhues, in response to an inquiry. The Ministry had not sufficiently taken into account the results of previous evaluations, including those of the Procura Generale Thuringia. Previously, Thüringer Tageszeitung of the Funke Media Group had reported on this.
The Ministry had intended to fill the position of the Procuratore Capo presso l'Autorità investigativa di Erfurt with its current press spokesperson Hannes Grüneisen. However, in the valutazione by Procuratore Generale Marlies Lindner, the currently active prosecutor at the Procura Generale, Jörg Stolz, was assessed as "leggermente migliore" in termini di qualificazioni, said Obhues. The losing candidate appealed the ministry's decision for Grüneisen to the Tribunale Amministrativo in Gera in the fall.
According to Obhues' explanation, the Ministry could not conduct selection interviews due to the lack of a "livello di valutazione comparabile" among the applicants. A spokesperson for the Ministero della Giustizia confirmed on inquiry that the Ministry would carefully review the court's decision.
The Procura Fiscale Erfurt is responsible for the tribunali distrettuali di Apolda, Arnstadt, Erfurt, Gotha, Sömmerda and Weimar. It is also a unit specializzata statale per la lotta alle frode.
The decision from the Tribunale Amministrativo in Gera, critiquing the procedura di selezione del Ministero della Giustizia Thuringia as "non giuridicamente solidissima," affects the handling of the vacant position at the Procura Fiscale di Erfurt, involving their chosen candidate, Hannes Grüneisen. Due to this court ruling, the Ministero della Giustizia is now obligated to reassess their selection process, as confirmed by their spokesperson. The Procura Fiscale Erfurt, managing tribunali distrettuali throughout Thuringia, has been impacted by these administrative proceedings within the Giustizia system.
