Former national player on trial - Warning and fine for Jerome Boateng

The Munich I Regional Court has found former football national player Jérôme Boateng guilty of intentional bodily harm and warned him accordingly. A suspended fine of 40 installments, each of 5,000 Euro, was imposed. Similar to a suspended prison sentence, Boateng only needs to pay the 200,000 Euro if he violates the conditions. The court ordered him to pay 50,000 Euro each to two charitable institutions that work for children. As Judge Susanne Hemmerich stated, "In my opinion, the real sufferers in this case are the children."

The court concluded that "the accusation of a notorious woman beater has vanished," as Judge Hemmerich put it. The prosecution had demanded a fine of 1.12 million Euro, while the defense at most advocated for a "moderate fine" for negligent bodily harm or the dismissal of the case against a monetary penalty.

Boateng denied the allegations

Boateng denied hitting his former partner, the mother of his twin daughters, during their vacation in 2018 with a windsurfing sail and a cooler box. At the first trial day, Boateng spoke of a "nightmare," while his lawyer in his plea referred to a "fabricated narrative of the woman beater," a "mutual body harm," and Boateng pushing his ex-girlfriend away and injuring her lip.

The lawyer for Boateng's ex-girlfriend, who accuses him of violence, stated, "It's a real David-versus-Goliath battle." Boateng shows "no sense of injustice." Lawyer Carolin Lütcke expressed satisfaction with the judgment. However, she is still considering whether to file an appeal.

Lengthy proceedings

The proceedings against the long-standing defender of FC Bayern Munich, who recently transferred from the Italian club US Salernitana to the Linzer ASK in Austria, are lengthy. The Munich Amtsgericht had already imposed a fine on Boateng in 2021: 60 installments of 30,000 Euro each, totaling 1.8 million Euro.

The Munich I Regional Court then sentenced Boateng in the second instance in October 2022 for bodily harm and defamation to a fine of 120 installments of 10,000 Euro - a total of 1.2 million Euro. However, the Bavarian Highest Regional Court quashed the judgment due to persistent legal errors - hence, the case was rolled back before the Munich I Regional Court.
