Jan Böhmermann and beekeeper Rico Heinzig can't see eye to eye. The talk show host says his personal rights were breached when Heinzig utilized his name and picture for promoting a honey. A verdict is on the horizon, slated for mid-July.
The "Honey Controversy" between ZDF satirist Jan Böhmermann and Saxon apiarist Rico Heinzig took another unsuccessful turn toward reconciliation. In the first hearing regarding Böhmermann's appeal against the Dresden District Court's verdict, both participants voiced their perspectives to a Civil Senate of the Dresden High Court (OLG). The verdict is on the 18th of July, the presiding judge shared after approximately an hour.
Böhmermann, represented by an attorney, argues that his personal rights were infringed upon due to the usage of his name and likeness, which Heinzig used for advertising a "beewashing" honey.
The source of conflict can be traced back to a "ZDF Magazin Royale" episode airing on November 3, 2023. In this segment, Böhmermann lambasted companies that awarded bee patronages to corporations and claimed this as green engagement for sustainability and species preservation. He bugged the audience with the phrase "beewashing" – describing it as deceptive advertising with environmental characteristics attached to a product.
Judge shows sympathy for lower court's views in certain aspects
As a reaction to the segment, Heinzig and his My Honey GmbH released a honey with a "beewashing" label and promoted it in a Dresden supermarket with a sign that displayed Böhmermann's image and the caption "Recommended by the leading bee and ant expert."
Böhmermann retaliated by sending Heinzig's company a cease and desist order, which turned out to be fruitless. He then went to the Dresden District Court seeking a temporary injunction. A civil judge refused Böhmermann's request and predominantly sided with the beekeeper.
The presiding judge stated that the senate might concur with the views of the lower court in certain aspects. For example, the satirical character of the critical poster is evident. Someone familiar with Böhmermann can appreciate the poster featuring his image from the episode alongside a "teacher-like, know-it-all gesture with the outstretched index finger" as a barb directed at the program.
