State parliament - The Landesgesetz on Expulsions was enacted

Administrative courts in Rhineland-Palatinate continue to decide whether a dwelling can be searched to find absentees. The Landtag in Mainz passed this unanimously and without further discussion. Justice Minister Herbert Mertin (FDP) previously referred to this competence being upheld and therefore maintained.

The federal legislator decided at the beginning of the year with the so-called Return Improvement Law that for the issuance of search warrants for the purpose of deportations, starting from August 2024, the district courts are competent. However, the federal states were given the opportunity to transfer this competence to the administrative courts.

In response to the federal law, the State parliament of Rhineland-Palatinate, located in Mainz, deliberated on the transfer of competence for deportation-related search warrant issuances. They decided unanimously to keep this power with the Administrative Court, ensuring continued diligence in justice matters. This decision has raised debates among foreigners residing in the region, as they closely monitor developments related to their potential residency.
