The dismissal occurred halfway through July due to Cannon's belief that the appointment of special counsel Smith by Attorney General Merrick Garland to oversee the investigation was unconstitutional, conceding to Trump's legal team's petition.
In the filing, Smith put forth various arguments, including the fact that the Attorney General has a "long-standing practice" of appointing special counsel, a practice that has earned congressional approval.
A trial involving Donald Trump is unlikely to occur prior to the U.S. elections
Trump's legal team now has 30 days to respond to Smith's filing. Following this, Smith will have 21 days to respond. Given the current pace, a possible trial against the Republican presidential contender probably won't occur before the election on November 5.
