The FDA has lifted the ban on marketing Juul's vaping products.
Juul shared news on Thursday that their products will continue to be available on the market while undergoing a scientific review.
A marketing ban for Juul's goods, including devices and tobacco and menthol-flavored pods, was put in place by the FDA in 2022. However, this order was put on hold a few weeks later, due to "scientific concerns that warranted further evaluation." The ban has not been withdrawn since.
The FDA stated on Thursday that recent court judgments have altered their technique for reviewing products to ensure they make decisions that are in line with both science and legal requirements.
The withdrawal of the marketing ban "is not a form of approval or denial and does not indicate if the applications are likely to be approved or denied," the FDA confirmed on Thursday.
The FDA added, "It's important to note that all e-cigarette goods, including those created by JUUL, must have FDA authorisation to be legally sold."
Juul, in a statement, said they are excited to "reconnect with the agency on a scientific and evidence-based process to pursue a marketing authorization for JUUL products."
The American Lung Association expressed concern on Thursday about the FDA's decision.
"We are deeply worried by the FDA's choice to rescind the marketing denial orders for JUUL," said Erika Sward, the association's assistant vice president of nationwide advocacy, in a statement. "Juul is primarily responsible for the youth e-cigarette epidemic from 2017 to 2019. These products and its maker do not meet the standard for safeguarding public health. We urge the FDA to issue marketing denial orders for all Juul products."
