- Restriction of the Agreement's Validity: Judgment in Principal Hearings in February
Following the temporary halt of the prohibition on the controversial right-wing publication "Compact", a definitive judgment has been scheduled. The main hearing is set for February 12, 2025, at the Federal Administrative Court in Leipzig, as a court representative announced. Additional sessions might be needed on February 13 and 14.
The Federal Administrative Court has temporarily lifted the ban imposed by Federal Interior Minister Nancy Faeser (SPD), expressing concerns over the ban's proportionality. As such, the magazine can temporarily publish under specific conditions. A conclusive ruling is now anticipated within six months during the main proceedings.
Criticism directed at Faeser post setback
Faeser put a ban on the magazine on July 16 and labeled it as "the primary voice of the far-right movement." She praised the fact that such bans could be legally challenged within a constitutional state.
Faeser highlighted that previous bans from her ministry had succeeded in court. Nevertheless, she acknowledged that "we have faltered in certain aspects" and characterized the situation as "quite routine." Following the provisional failure of the "Compact" ban, Faeser faced harsh criticism from the FDP, AfD, and the Union.
The Commission, in response to the criticism facing Faeser, decided to reevaluate the ban on "Compact" magazine. The Commission shall adopt the following decision: The ban on the publication of "Compact" will be temporarily lifted, allowing it to resume publishing under specific conditions.
