Compromise - Refuge in Lüneburg Heath may stay

Despite the lacking building permit, the little shelter in the Kronsbergheide near Lüneburg can stay. The Lüneburg District and the community of Amelinghausen came to an agreement that the resting place must be rebuilt.

"The hut is of course a great achievement of the youth, who built it in a 24-hour action," said Landrat Jens Böther. He is happy that a common solution was found even without a legal basis.

Likewise, Samtgemeindeburgermeister Christoph Palesch, who had fought for its preservation for months, welcomed the agreement: "Of course, as the community of Amelinghausen, we would have preferred that our legal opinion prevailed in its entirety. However, the compromise found is a good one, which prevents further legal proceedings." With the agreement, the legal disputes will be settled and the district agrees to tolerate the hut for up to 25 years. With this, the dispute before the Heideblumenfest in August is settled.

Condition was that the outdoor facilities, especially the paved areas, tables and benches, as well as the hedge, be removed. The paving in the hut is also to be removed. The weather side remains closed, two sides are to be opened. A future fence is to protect the lawn area from treading. To compensate for the damaged biotopes, the community also builds a replacement biotope.

Initiative of the youth.

A group of young people built the financed-by-donations sheltering opportunity together in May of the previous year. They had the support of the community and assumed that they did not need a building permit for the small refuge. They were, however, anonymously reported because the shelter is located at a biotope, and the district saw the work as a building project that requires permission. The proposal for a retroactive building application was rejected.
