conflict escalates - Process ends with acquittal after being shot in the leg
Four months after shots were fired at a local in Berlin-Mariendorf with an injured person, a suspect was acquitted by the Tiergarten Magistrates' Court. The court could not establish a secure conviction that the 28-year-old had shot, justifying the ruling in the dangerous bodily harm trial following the prosecutor's application.
According to investigations, a man had fired two shots in the early hours of March 9th. A 42-year-old man was hit in the leg. The victim's statements led to the accusation against the 28-year-old. The trained hairdresser remained silent about the allegations.
According to the 42-year-old's testimony, there was initially a dispute between the 28-year-old and other guests in the local. "I wanted to mediate, then he attacked me," the 42-year-old testified in court. Eventually, he left the local and was attacked by two other men. There was a fight. Then, the defendant got out of a car and "first in the air, then at me shot."
A witness, who was walking her dog at the time, could not identify the defendant as the shooter. The evidence was scarce, the prosecutor noted. It remains open whether the defendant fired the shots.
- Despite the Public Prosecutor's Office aggressively pursuing the case for dangerous bodily harm, the Tiergarten District Court issued an acquittal for the suspect in the Berlin-Mariendorf incident.
- The justice process in the court following the prosecutor's application resulted in the defendant being cleared of any involvement in the harm caused by the gunshots in the Tiergarten District Court.
- The Berlin-Mariendorf shooting incident, in which a man was injured with gunshots, was heard at the Tiergarten District Court, leading to an acquittal for the suspect in the case of causing public body harm.
- Although the shooting incident in the Tiergarten District of Berlin left a victim with harm, the court could not securely convict the suspect due to insufficient evidence, thus leading to his acquittal.
