Criminality - Lifelong imprisonment for murder in a homeless shelter

The Landgericht Ulm sentenced a 25-year-old man to life imprisonment for Murder. The chamber found it proven that the man had killed a 57-year-old woman in a Goppinger Shelter last September. The court agreed with the prosecution's demand, which the defense had largely joined. The defense had called for acquittal.

Many questions remain open

The exact motive for the crime remained unclear. The court assumed that the Moroccan, who did not live in the shelter himself, was looking for a man in the Shelter. In the upper story, he had attempted to break into three rooms. One was empty, another would not open, and the third door had given way. In this room, the 57-year-old woman had been sitting. According to the statements, there was no relationship between the 25-year-old and the woman.

In the chamber's view, the 25-year-old wanted to know from the Woman where the man was whom he was looking for. She had not known. The man had attacked her more than 50 times, according to the court, with an unknown object and stabbed her with a knife. "He who approaches from the throat wants to kill," said the presiding judge.

Circumstances indicating a low base speed or concealment of intent were considered by the court as aggravating circumstances. No evidence of diminished capacity for responsibility was given, said the judge. The judgment is not final.

  1. The 25-year-old's case will be appealed to the Higher Regional Court in Stuttgart, which is located in the state of Baden-Württemberg, specifically in the city of Stuttgart.
  2. The Public Prosecutor's Office in Ulm will be responsible for prosecuting the appeal.
  3. In the meantime, the 25-year-old will serve his sentence in a prison in Germany.
  4. The sentence for murder in Germany is typically served in a maximum-security prison, with the possibility of parole after 15 years.
  5. Once the sentence has been served, the 25-year-old will be released, unless there are other legal reasons for him to remain in custody.
  6. In a related matter, there have been calls for the German government to create more shelters for the homeless, with the aim of preventing such incidents from happening again.
