- Inquest Underway for Alleged Negligent Homicide Following Bayesian System Malfunction
The Legal Authority is examining several instances of unintentional homicide after the luxury vessel "Bayesian" sank near Sicily's coast. The objective is to establish if the vessel went under due to underestimating the severity of the forthcoming storm. At this point, though, the examination is not focusing on the captain or the crew members specifically.
This unfortunate incident resulted in the death of seven individuals close to the Italian Mediterranean island's shore on Monday. Seventeen individuals were saved, with the majority being crew members. Prominent British entrepreneur Mike Lynch embarked on this sailing adventure with his family, friends, and business associates to celebrate his acquittal in court.
Inspectors: Yacht "Bayesian" Encountered by whirlpool
Inspectors assert that the "Bayesian" was hit by a whirlpool in the early hours of the morning during a storm with wind speeds surpassing 100 kilometers per hour, resulting in its rapid sinking. Raffaele Cammarano, the State Prosecutor, stated at a press conference in Palermo: "It was an abrupt, sudden incident." Nevertheless, other captains in the area had managed to secure their vessels earlier.
Whirlpools materialize, according to the German Meteorological Service, when chilly air descends in a thunderstorm, collides with the ground, and expands in a straight pattern. Up close, they resemble a "white wall" moving at blazing speed. They often cause more damage than tornadoes.
Recovery may take several weeks
The inspectors anticipate gaining valuable information from the so-called black box of the 56-meter-long luxury yacht, which has yet to be located. Additionally, the Legal Authority wishes to wait for the retrieval of the ship before expanding the investigation, which might take several weeks. The 500-ton yacht - one of the largest sailing ships in the world - is currently submerged 1 kilometer off the small harbor of Porticello in 50 meters of water.
However, the Legal Authority has not ruled out the possibility of certain parties being listed as potential suspects beforehand. This would enable them to access the files according to Italian law. Ambrogio Cartosio, the State Prosecutor, stated: "There's no rush. One must identify who is responsible for the crime. This could involve the captain and crew, as well as the manufacturer."
Sister pays heartfelt tribute
In this context, it's also crucial to determine why, apart from the ship's cook, all crew members survived, but only a half of the twelve passengers. It's suspected that the victims were caught off guard in their cabins while asleep and couldn't escape. There are also rumors of a gathering the previous night. According to the inspectors, no alcohol tests were conducted on the survivors.
While Lynch's daughter Esme offered a heartfelt farewell to her younger sister Hannah, 18. "She is my little angel, my heroine," it was stated in a family announcement. "Hannah would often burst into my bedroom and climb into bed with me. Sometimes she was smiling, sometimes she was playful, sometimes she sought advice. No matter what happened, she showered me with unending love." Esme wasn't present on the ship. The mother made it through the disaster.
Lynch was among Britain's wealthiest individuals. He amassed billions from the sale of his software company to the American conglomerate Hewlett Packard. However, the acquisition proved to be a failure, leading to prolonged legal disputes. A court recently absolved Lynch.
Despite the inspectors' belief that the luxury yacht "Bayesian" was caught in a whirlpool during the storm, questions remain about why only half of the passengers perished while all crew members survived. The Legal Authority is considering potential suspects among the captain, crew, and even the manufacturer, as the investigation continues.
The tragic loss of Lynch's daughter Hannah on the luxury yacht "Bayesian" led to a heartfelt tribute from her sister Esme. Hannah, remembered as a loving and playful sibling, was often found climbing into Esme's bedroom for comfort and companionship.
