German government examines effects of court ruling on immediate climate protection measures

The German government is examining the effects of the court ruling on immediate climate protection measures. The court's decision is "still very recent" and is now being evaluated, according to government circles on Thursday. It is possible that the Federal Government will have to specify its climate plans and present an immediate program for the areas of buildings and transport. However, an appeal against the decision is also possible.

On Thursday, the Berlin-Brandenburg Higher Administrative Court upheld the complaints of two environmental associations. It obliged the federal government to submit immediate programs in the areas of buildings and transport. These two areas have failed to meet the mandatory targets of the Climate Protection Act for CO2 reduction in 2021 and 2022. According to the judges, the amended 2023 climate protection program submitted in October does not meet the legal requirements for the immediate action program.

In government circles, it was pointed out that the amended climate program is still in the parliamentary process. It is possible that further changes will be made here. However, it is not yet possible to say much concretely about the exact effects of the ruling before the precise evaluation.

"We will of course respect the rulings of the Higher Administrative Court and evaluate them as soon as they are available," said a spokesperson for the Federal Ministry of Construction in response to an inquiry. "We will examine how to proceed once we have received the reasons." This "naturally also includes examining measures that comply with the court's rulings".

  1. The court's judgment might necessitate the Federal Government to outline immediate measures in the sectors of buildings and transportation to align with climate protection targets, as suggested by government circles following the ruling.
  2. In light of the court's decision, the German Government is assessing the potential impacts on their immediate climate protection plans, particularly in relation to the Federal Government's climate plans for buildings and transportation.
  3. The Federal Government is currently weighing the possibilities of appealing the court judgment and specifying its climate protection plans, or implementing immediate measures in response to the court's ruling in the areas of buildings and transportation for climate protection.
