Trial for manslaughter - Fatal brawl: Three men in court
Three men, aged 30, 38, and 52, stand before the Berlin Criminal Court due to allegedly injuring a 50-year-old man fatally in a brawl. Approximately six months after the incident at a local in the Wedding district, the defendants declared that the aggression had not originated from them. The defense attorney for the 38-year-old stated that his client had only "wanted to defend himself." They had all been significantly intoxicated. The lawyer for the 52-year-old stated that his client had "behaved defensively in all situations." The later victim had attacked.
The prosecution accuses the 30, 38, and 52-year-old men of manslaughter. On the night of January 17th, the three defendants, "due to a spontaneously formed common plan," attacked the 50-year-old. Prior to the incident, all four men had met at a local. It was reported at the trial's edge that a verbal altercation had already occurred there.
Massive blows with a telescopic baton
One of the defendants was armed with a telescopic baton and had struck the 50-year-old on both his body and head, according to the prosecution. The defendants had also continued to strike and trample on him as he lay on the ground. "They only left him and departed when the man was lifeless and unconscious."
The 50-year-old died shortly thereafter in a hospital. The defendants - two of whom were Moldovan citizens, and one was a German-Kazakh - were arrested shortly after the incident and have been in investigative detention since then. The trial continues on July 15th.
The public prosecutor's office strongly contends that the use of a telescopic baton by one of the defendants played a significant role in the 50-year-old's fatal injuries, contributing to the allegations of manslaughter. The defense for the German-Kazakh defendant maintains that his client was not involved in the aggression beyond initially trying to diffuse the situation.
