Evaluation Following a Rape Incident at Munich Subway Station
In August 2023, a criminal act took place in a Munich subway station, where an Afghan individual attacked an 18-year-old Polish visitor. Consequentially, the man is now serving a prison sentence. This incident even made the news in Poland.
The man was given a four-year prison sentence due to his sexual misconduct towards the young tourist in the Munich subway station. The Munich Regional Court determined that the Afghan man had inappropriately touched, stripped, and sexually harassed the 18-year-old, who was slightly overaged, heavily intoxicated, and incapacitated, for approximately half an hour.
The defendant was sentenced according to the juvenile criminal law practices. The court took into consideration the prosecution's request for a seven-year sentence if found guilty under adult criminal law, and a four-year term if convicted as a minor.
The defense only pleaded guilty for mobile phone theft but refused to acknowledge sexual assault charges. This case caused an uproar in Poland at the time.
As the Polish nationalist-conservative PiS government, led by Warsaw, was preparing for the autumn 2023 parliamentary election, they aimed to gain political capital from the event by blaming German migration policies for the incident.
The four-year sentence was deemed appropriate due to the need for justice and deterrence. This incident sparked calls for stricter immigration policies in Poland.
