Enforced new threshold for cannabis consumption while driving now in effect
Under the influence of cannabis, there's a new limit for drivers. Just like the 0.5 per mille limit for alcohol, this new regulation applies to the intoxicating substance THC. For drivers to be fined, they must have 3.5 nanograms of THC per milliliter of blood or more. This results in a fine of 500 euros and a one-month driving ban. If alcohol is consumed as well, the fine can reach 1000 euros. These traffic regulations were introduced following the partial legalization of cannabis, which allows adults to smoke and grow the substance under certain conditions since April 1. The Federal Ministry of Transport claims that the new law provides legal certainty and clarity.
For novice and young drivers, special regulations have been introduced to ensure road safety. Just like with alcohol, cannabis is completely banned for drivers under 21 years old or within the first two years of obtaining a license. Violations can result in a fine of 250 euros, but there's no driving ban.
Previously, any trace of THC in the body could lead to consequences, but there was no specific limit. However, in legal practice, a value of 1 nanogram was commonly used. Experts at the Traffic Court Day advocated for a "reasonable" increase in 2022, arguing that the value was too low and many people were being penalized without evidence of impaired driving. Yet, this proposal faced criticism from police representatives.
The implementation of the new traffic regulations has led to a focus on road transport, as drivers now need to be aware of the THC limit. Despite the partial legalization of cannabis, it's crucial for drivers to understand that THC is still prohibited while driving for individuals under 21 or within their first two years of licensure.
