Doctor facing penalty after mask certificates

During the coronavirus period, the doctor issued mask exemption certificates in sequence without examining the patients. Appeals were filed against the verdict for the doctor.

The probation sentence for a doctor from upper Bavaria, Kaufering, for issuing false certificates to exempt from mask wearing obligation is valid. He was sentenced to a prison term of one year and nine months in November 2023, which was suspended. The appeals against the judgment by the defendant and the Public Prosecutor's Office Augsburg have been withdrawn, according to the Regional Court Augsburg. The 61-year-old doctor is now under probation.

The doctor, according to the verdict, issued 112 certificates for mask exemption during the Corona period without examining the patients. Each certificate cost the patients 17 Euro. Two practice employees are said to have filled out the blank certificates and forwarded them to recipients throughout Germany. The doctor became known nationwide during the pandemic due to his opposing attitude towards the government regulations.

The Public Prosecutor's Office demanded three years in prison for the man. The investigators assumed that he had distributed a total of more than 4000 false certificates. Only a part of it was mentioned in the indictment. The defense lawyer demanded an acquittal for the doctor, at most a probation sentence.

  6. The financial consequences for recipients who paid 17 Euros each for the false certificates remain an unresolved issue in the court proceedings, which may necessitate separate Judgments for reimbursements.
  7. Despite his notoriety during the pandemic for opposing government regulations, the doctor's actions have resulted in serious consequences, including a probation sentence following his conviction for criminality related to mask exemptions during the Corona period.
