Christina Block is making an appeal to Karlsruhe [city name]
The ongoing custody battle within the Block family is taking a new turn. According to their legal advisors, Christina Block from Hamburg has filed a constitutional petition in Karlsruhe. Simultaneously, the authorities are still probing Christina and her father for alleged child kidnapping charges.
Christina, a successful entrepreneur from Hamburg, has sought the intervention of the Federal Constitutional Court in Karlsruhe to address the alleged breach of her due legal process and that of her children. Her legal counsel from Berlin, specializing in constitutional law, has filed the complaint on her behalf. It was noted that the complaint also highlights the denial of her right to legal hearing.
The custody battle has been ongoing for years between Christina and her ex-spouse for the custody of their two younger children, aged around 10 and 13 years. Since late August 2021, the kids have been residing with their father in Denmark, following their failure to return to their mother after a scheduled visit. In October 2021, the Hanseatic Higher Regional Court granted Christina the authority to determine her children's residence. However, the court ruled in February 2024 that German courts no longer held jurisdiction, as the children had fully established their permanent residence in Denmark.
On New Year's Eve, these two children were clandestinely moved to Germany by unidentified individuals. Upon a court order, however, Christina was compelled to return the children to Denmark once again. The public prosecutor's office is currently investigating Christina and her father, Eugen Block, the founder of the Block House restaurant chain, for alleged child abduction. They are suspected of masterminding and executing the kidnapping on New Year's Eve with the assistance of other suspects. The prosecutor's office has conducted multiple searches on both business and private premises.
In the criminal case, Christina's legal counsel maintains that she did not direct any third-party to abduct her children from Denmark by force. In response to a query by the "Hamburger Abendblatt" in late May, Eugen Block said, "I have no involvement in this matter and cannot comment on it."
Christina's constitutional petition at the Federal Constitutional Court in Karlsruhe challenges the alleged violation of her fundamental rights and those of her children, as stated in the petition. The intervention of the Federal Constitutional Court becomes crucial in this ongoing custody battle, considering the complex legal issues involved.
