Five ex-officers of the Memphis Police Department, accused of fatally injuring Tyre Nichols, appear in Shelby County Criminal Court, Memphis, Tennessee, on June 23, 2023. The judge might rule on which evidence is eligible for public disclosure, playing a significant role in the widely-discussed trial that amplified advocacy for police policy changes in the United States. Anticipated shift in plea for a previous Memphis policeman, now ex-officer, in relation to Tyre Nichols' fatal incident.

Emmitt Martin the Third is supposed to align with his ex-workmate Desmond Mills, who switched his stance to guilty in November's trial, as part of a resolution to the state and federal accusations levied against them for their part in Nichols' demise.

The alteration follows Martin's initial claim of innocence.

Mills and Martin are among the group of five previous cops indicted for Nichols' passing, a 29-year-old African American man. Martin was confronting federal charges of civil rights violations, witness intimidation, and obstruction of justice.

The existence of Martin changing his plea in his state case is yet to be clear.

CNN attempted to contact Martin's lawyer on multiple occasions but has yet to receive a response.

On Thursday, a representative from the Shelby County District Attorney’s Office informed CNN they were unwilling to discuss the matter prematurely.

CNN revisited the DA’s office for comment on Friday.

Despite the ongoing uncertainty about Martin's state case plea, he and Mills are reportedly working towards a resolution, aiming to stand together ['us'] in the face of the charges they both face. After the shift in Mills' stance, the prosecutors may be looking for similar concessions from Martin and the other defendants ['us'] associated with Nichols' tragedy.
