Alleged Misuse Accusation Resolution - Parents Released Following 684-Day Incarceration
After spending over two years in prison for allegedly abusing their daughter, a couple receives a posthumous acquittal in a reopened trial. Evidence and testimonials were found to be dubious, with videos appearing staged. The daughter herself fabricated the incidents.
A sense of freedom fills the faces of the exonerated couple: In a retrial, a Lower Saxony couple has been cleared of serious charges involving their daughter at the Braunschweig Regional Court. "The court is convinced that the 19 alleged incidents did not occur," the judge declared. This is considered a "solid acquittal."
The judge highlighted the case as "commendable," yet it's the outcome from the second trial reopening. In the initial trial, conducted by another chamber in Braunschweig, the mother was sentenced to a total of 13.5 years in prison with subsequent preventive detention in June 2023, while her partner received a nine-year and six-month sentence.
The Federal Court of Justice overturned the conviction on appeal, primarily due to inadequate evidence evaluation by the federal judges. The testimony capacity of the accused daughter also required clarification. The new chamber revoked the arrest warrants even before the trial commenced, stating that the couple remains under suspicion but not so strongly, as announced in June.
Friend of the daughter speaks up
The couple spent approximately two years in pre-trial custody prior to this. The judge declared, "684 days of unjust imprisonment necessitates compensation." Legal recourse remained possible, but the prosecution immediately waived further appeals, having also advocated for acquittal in secret pleadings. Defense attorneys concurred.
At the inception of the trial in August, the couple was still accused of repeatedly raping, abusing, and injuring their adult daughter. However, certain doubts emerged during and before the second trial. A final expert report unveiled "a relatively low probability of a truthful background" regarding the daughter’s testimonies.
Several investigators cast doubts on the credibility of the 26-year-old daughter during the trial. A past friend reportedly testified to the police and further corroborated the perception of a staged performance. Thorough reinvestigations and rediscovered chat conversations, as well as staged videos, significantly influenced the acquittal, the judge clarified.
"All allegations are baseless"
However, the acquittal also raises doubts about an earlier verdict. In 2022, the Regional Court sentenced a previous partner of the daughter to over six years in prison for severe abuse. The defendant confessed to a number of offenses, including sexual assault, grievous bodily harm, deprivation of liberty, and attempted murder against her life partner.
This confession likely led the original judge to believe the alleged victim on various occasions. The parents, now exonerated, became suspects following this verdict. The judge offered a review, pointing out the inconsistencies in the first trial against the parents that were unaddressed.
During the second trial, the panel concluded: "All allegations against each and every individual are unsubstantiated." Clearly, the question arises as to what might motivate someone to fabricate such tales, the judge mentioned. Seeking attention, desire for recognition, or perhaps false memories? Answers can only be obtained through additional investigations and further clarification, which is urgently required – not only for the two former friends of the alleged victim, but also for those left traumatized by the events.
