AfD fails with lawsuit against EU corona fund

During the coronavirus pandemic, the EU Commission is setting up a special fund worth 750 billion euros to cushion the economic consequences of the crisis. Germany should and would also like to contribute. The AfD takes legal action against this - and loses before the Federal Constitutional Court.

An action brought by the AfD parliamentary group against Germany's participation in the European Union's coronavirus aid fund has failed before the Federal Constitutional Court. The court dismissed the action as inadmissible, as it announced in Karlsruhe. The Constitutional Court had already ruled in December that Germany was allowed to participate in the aid fund as a result of other lawsuits - at that time it was about other lawsuits.

The European heads of state and government want to use the recovery fund to cushion the consequences of the pandemic. The European Commission was exceptionally authorized to borrow 750 billion euros on the capital markets - at 2018 prices - and to pass these on to the member states as grants or loans for a specific purpose. The EU countries are jointly liable for repayment.

The Bundestag and Bundesrat approved this in March 2021, and Federal President Frank-Walter Steinmeier signed the German ratification law in April 2021. The now failed AfD lawsuit was specifically directed against the involvement of the Federal Government in the European decision and against the involvement of the Federal Government and Bundestag in the German law.
