Migration - Refugee council criticizes repeated deportation of a man
The Refugee Council criticizes once again the proceedings of the Saxon authorities regarding the deportation of a foreigner. A Moroccan was deported on July 11th, despite the Administrative Court of Chemnitz having ruled in an emergency decree that the deportation must be suspended. The decision of the court was disregarded, the Refugee Council stated.
Officials at the City Chemnitz and the Saxony State Directorate had informed the lawyer of the affected person in phone calls that they felt not bound by the decision. They had also not forwarded it to the Federal Police, which is why the deportation was continued.
The spokesperson for the City of Chemnitz, Matthias Nowak, stated in response to an inquiry that the Foreigners' Office of the City of Chemnitz was not responsible for the deportation. "This and nothing else was also communicated to the court and the lawyer of the man," he stated.
The State Directorate stated that they became aware of the court decision during the ongoing deportation. The decision was, however, against the Foreigners' Office of the City of Chemnitz; the State Directorate had not been involved in the judicial proceedings at any time. "Given the short time available, a decision was made to stop the ongoing deportation," stated spokeswoman Valerie Eckl.
The State Directorate is currently internally investigating the matter and is also examining the possibility that the Moroccan can temporarily return. The man had applied for a residence permit at the Chemnitz Foreigners' Office based on family reasons. This procedure is ongoing. According to the Refugee Council, the man is married to a German citizen and has children with her.
At the beginning of this week, there was turmoil regarding the planned deportation of another man from Saxony to Serbia. Politicians from various parties criticized the procedure. The Interior Minister temporarily halted the deportation. Now, the Hate Crimes Commission is supposed to deal with the case of the 31-year-old man.
