Child pornography - Proceedings against the teacher for child pornography have been discontinued
The proceedings against a teacher from Westerwald for distribution, production and possession of child pornography have been discontinued. This was announced by the Amtsgericht Montabaur. The enacted legislative amendments on June 28 enabled this.
This had lowered the minimum sentence for the distribution, requesting, and possession of such material. Previously, people had to be punished who, for example, forwarded nude photos to warn or help the affected persons. The teacher had wanted to help a 13-year-old student who had taken intimate photos of herself and sent them to her boyfriend. This boyfriend is said to have distributed the video, the teacher obtained it and obtained it herself to pass it on to the child's mother and protect her.
The Public Prosecutor's Office Koblenz and the defendant agreed to the discontinuation of the proceedings. Even if a finding of fact had been established in a main hearing, the court ruling states that the teacher's guilt was so minor that there was no public interest in prosecution.
The judgment is not appealable, and the proceedings are therefore concluded. The court costs and necessary expenses of the defendant were charged to the state treasury.
