Minister welcomes plans for the protection of the Constitutional Court

The Federal Constitutional Court should be better protected from extremists. For this, central directives regarding the structure in the Basic Law should be anchored.

Justice - Minister welcomes plans for the protection of the Constitutional Court

Planned amendment to strengthen the Federal Constitutional Court gains approval from Lower Saxony Justice Minister Kathrin Wahlmann. "The fact that a broad over-party alliance has formed to strengthen the Federal Constitutional Court is a clear sign to all enemies of our democracy", stated the SPD politician to Redaktionsnetzwerk Deutschland (RND). Wahlmann currently chairs the Justice Ministers Conference.

"Our goal must be to build a strong protective wall around this guardian of our freely democratic constitutional state. It is and remains the right way to anchor regulations for the protection of the Federal Constitutional Court in the Basic Law", said the Minister.

The Traffic Light Coalition and Union factions at the federal level have agreed to anchor the number of judges and senates, as well as central provisions regarding the structure of the Federal Constitutional Court, in the Basic Law. They aim to secure the independence and functionality of the Court even in turbulent times.

So far, changes that carry the risk of a blockade or political instrumentalization could theoretically be passed with a simple majority. However, for a change or amendment to the wording of the Basic Law, a two-thirds majority in the Bundestag and Bundesrat is required. The Court currently has 16 judges and senators.

  5. The agreement by the Traffic Light Coalition and Union factions at the federal level aims to secure the Court's independence and functionality by anchoring its structure and judges in the German Constitution.
  6. The Court, currently composed of 16 judges and senators, is thought to gain more strength and stability through these constitutional amendments, strengthening Germany's commitment to its democratic principles.
  7. The Federal Constitutional Court, as Germany's guardian of Democracy and Constitutional Law, will continue to play a crucial role in setting the tone for justice and upholding constitutional law in Hannover and across the country.
