Bayern lets Cannabis clubs wait for approvals

After legalization - Bayern lets Cannabis clubs wait for approvals

For those looking to legally cultivate Cannabis in Bavaria for Anbauvereinigations (Cannabis Social Clubs), they will have to wait a while longer before getting the green light. A spokesperson for the Bavarian Health and Food Safety Authority (LGL) stated that applicants must prove that they have undergone sufficient training and consultation for approval. However, such trainings in Bavaria from the Center for Prevention and Health Promotion are not scheduled until September.

Waiting for a Model Curriculum

Applicants for Anbauvereinigungen could undergo training elsewhere, but according to the LGL, they would then need to present a detailed, signed description of the training content from a recognized institution in the respective federal state for approval. The LGL would then review the potential recognition of the qualification. A model curriculum from the Federal Ministry of Health is expected to serve as a reference, but the states are likely to receive it only in August.

Twelve Applications, No Approvals

According to the LGL, twelve applications for Anbauvereinigungen in Bavaria have been submitted, but no approvals have been granted yet.

The Bavarian Health Ministry had previously announced before the legalization of Anbauvereinigungen on July 1st that the rules would be implemented in a maximally restrictive manner, in line with the CSU-led state government's maxim. To this end, a central unit will be established at the LGL.

Four Inspections Planned per Year

The permit procedure in Bavaria is "focused on prevention," emphasized Health Minister Judith Gerlach (CSU) prior to the event. Part of the process includes "on-site inspections in cooperation with the police and hearings from the affected municipalities." In addition, each Anbauvereinigung will be inspected on-site once per quarter, with the possibility of more frequent inspections if necessary.

  4. In an effort to uphold the CSU-led state government's maxim, a central unit will be established at the Bavarian Health and Food Safety Authority (LGL) for the implementation of the rules governing Anbauvereinigungen with a focus on prevention.
  5. To ensure compliance with the regulations, each Anbauvereinigung in Bavaria will undergo on-site inspections four times a year, in partnership with the police and affected municipalities, and additional inspections may be conducted if necessary.
