Sentencing in hospital: A 57-year-old man has been sentenced to eight years in prison for raping a young woman in Hamburg-Horn. The district court also ordered him to be placed in a psychiatric hospital. As the defendant fell seriously ill after the so-called last word, the sentence was handed down in hospital on December 4, as a court spokesperson announced on Friday evening.

According to the indictment, the 19-year-old had stayed in the defendant's apartment as a guest for several days together with her partner. On March 11 of this year, the 57-year-old wanted to speak to the woman alone under a pretext around midday. He had previously sent her partner away from the apartment. According to the public prosecutor's office, the accused then took a knife from the kitchen, threatened the 19-year-old with it and raped her.

The accused was convicted of particularly serious rape combined with coercion, the court spokesman added. The verdict has now become final. The court assumed that the assault had essentially taken place as charged.

"The defendant only had limited culpability, as he was significantly impaired in his ability to control himself due to several neurological-cognitive and psychological impairments," it said. In view of numerous previous convictions, including for sexual offenses, the chamber saw the danger that the defendant would commit serious crimes again. For this reason, placement in a psychiatric ward had also been ordered.
