Following a reassessment, a separate court in the appellate system declared on Thursday that the crime scene and brutality, notwithstanding the decreased liability of the defendant, warranted the verdict, as per a representative of the district court.
In the wake of a disagreement of undisclosed origin, the inebriated defendant - the court established a blood alcohol concentration of at least 1.6% - grabbed a knife with a 20-centimeter-long blade in Paderborn in March 2023 and impaled his wife thrice on her torso. He also intensely battered her. Subsequently, he attempted self-harm, but was unintentionally discovered by a neighbor who promptly summoned the paramedics.
An initial sentence of seven years in prison was imposed, which was subsequently rejected by the Federal Court of Justice following the defendant's appeal. The BGH objected to the fact that the initial sentence didn't sufficiently warrant the verdict.
