Verdict against caregiver: Senior citizen robbed of 380,000 euros
A carer has been jailed and ordered to pay back the sum for defrauding a senior citizen of a lottery prize of 380,000 euros. The Stuttgart Higher Regional Court thus confirmed a decision by the Hechingen Regional Court and rejected an appeal. This was announced by the Hechingen Regional Court on Monday.
The regional court had sentenced the care service operator to three years' imprisonment for embezzlement in appeal proceedings. She was also ordered to repay the embezzled amount. The caregiver's mother, who was a co-defendant at the time, also appealed against the district court's ruling. She was acquitted, but was ordered to repay 100,000 euros.
According to the OLG statement, the caregiver had cared for an 84-year-old man over a period of around six months. He played the lottery twice a week, always with the same combination of numbers. As he was no longer able to hand in the lottery ticket himself, he asked the defendant to do this for him, which she did. Due to a six in the lottery, the man won around 750,000 euros. As he was afraid that this money could be withheld by his caregiver or used for care costs, he agreed with the defendant that the money should first go into her account.
The caregiver also persuaded the senior that he should give her about half of the winnings, to which the man agreed. However, the carer kept all the money for herself and spent a large part of it. She transferred an amount of 100,000 euros to her mother. The senior died in June 2020 without ever having received a single euro from his lottery winnings.
The caregiver was convicted of embezzling 380,000 euros from a senior citizen, and the court ordered her to pay back this amount as restitution for her crimes. Additionally, the judgments against both the caregiver and her mother resulted in significant financial penalties.
