- Union's desired proposal by Minister Behrens: Deemed impractical
After the high-level migration meeting, Lower Saxony's Interior Minister Daniela Behrens, who represented SPD as co-chair of the Minister Presidents' Conference for Lower Saxony, believes that more discussions are necessary between the federal government and the states. She views the federal government's proposal for a fresh strategy towards illicit entries as a potential method to lessen entry opportunities and motivations for additional travel from other EU countries to Germany. Nonetheless, she stresses the importance of intensive discussions and implementation for this plan, which necessitates further negotiations between the federal government and the states.
Regarding the Union's lack of consensus, Behrens expressed disappointment, saying, "I'm sorry that the Union seems to have set the talks up for failure from the start." The Union's insistence on outright border rejections was found "impractical."
According to government sources, the Federal Interior Minister Nancy Faeser (also from SPD) suggested that in the future, the federal police should verify, upon illegal entry and expressed asylum request, whether another EU country is responsible for the asylum process and interrogate the foreigner. Eurodac identification data could be employed for this purpose. If detention facilities are available, the federal police could then petition for detention due to flight risk at the appropriate court.
Following this, the Federal Office for Migration and Refugees could initiate an expedited procedure for take-back by the responsible country in accordance with the Dublin rules. If detention is not an option, a fixed assignment and residence requirement should serve as an alternative.
