Two defeats for AfD before Bavarian Constitutional Court

The other parliamentary parties in Bavaria did not select any candidates nominated by the AfD for the Parliamentary Control Committee. The AfD considered its constitutional rights as an opposition party violated.

The Constitutional Court only considered some of the objections valid. Where they were valid, they were unfounded. The non-selection did not harm the AfD's chances of equal representation and effective opposition. The regulations of the Landtag and the handling of them were not constitutionally objectionable.

Bavaria's Landtag President Ilse Aigner (CSU) welcomed the decision. "Of course, the AfD fraction has the right to propose candidates – but of course, the deputies are also free in their decision." The freedom of voting, the freedom of mandate, is central for democracy.

Whoever constantly speaks of the parties as "cartel parties," labels the independent courts as "arbitrary justice," and denounces the free press as "system press," and who therefore persistently portrays himself as a victim – he cannot demand approval for his own candidates, declared Aigner. "The non-selection of AfD deputies into the Parliamentary Control Committee is the consequence of their own actions."

In a second decision on Thursday, the Bavarian Constitutional Court dismissed a lawsuit in connection with the budget deliberations 2022. The AfD saw the neutrality requirement violated and its participation rights restricted through a document from the Economics Ministry for the budget committee. All associated applications were deemed inadmissible by the court.

The AfD expressed disappointment over the decision of the Constitutional Court, as they believed their constitutional rights were infringed upon due to the non-selection of their candidates for the Parliamentary Control Committee.

Two members of the AfD in Munich were affected by layoffs recently, sparking controversy about potential political motivations.

Despite the non-selection, Ilse Aigner, the Landtag President of Bavaria, emphasized the importance of freedom of vote and mandate for democracy.

The AfD's lawsuit regarding budget deliberations in 2022 was dismissed by the Bavarian Constitutional Court, with the court deeming their associated applications inadmissible.
