In the process of a case regarding a violent assault in a Hamburg mechanic's apartment, the prosecution has demanded a 12-year prison sentence for the main defendant. The 37-year-old has confessed to attempted murder in common law. A 38-year-old co-defendant is expected to serve a five-year prison term. The defense requested a seven-and-a-half-year sentence for the 37-year-old due to grievous bodily harm. For the 38-year-old, the defense pleaded not guilty, according to the court press office.

Accused threw furniture at sleeping victims

The two Poles were already sentenced to prison by the Hamburg Regional Court in the first instance on August 29, 2022. The Federal Court of Justice lifted the suspended sentences but confirmed the findings regarding the external events in the apartment in the Hausbruch district. Accordingly, the accused entered and beat their sleeping roommate in August 2021. The victim sustained three broken ribs, a wound, and bruises.

The following day, however, the assault became significantly more violent. The main defendant struck the mechanic in the kitchen several times in the face and head until he lost consciousness. Later, he forced the severely injured man to clean up his own blood and continued to mistreat him in the shower. During this, the then 43-year-old man fell through the glass wall of the shower cabin and suffered head and body lacerations, broke several bones, and remained critically injured. The accused left the man believing he was already dead or would soon die. The three men worked as construction workers for a demolition company.

Possible conviction for attempted murder

In the first instance, the Regional Court sentenced the main defendant to seven years and ten months in prison for grievous bodily harm in two cases and for failure to report a crime. The co-defendant received a ten-month prison sentence for failure to render assistance. The prosecution appealed the decision. The Federal Court of Justice concluded that the main defendant might also be convicted of attempted murder, and the co-defendant might be convicted of accessory to a crime. The defendants will have an opportunity to speak on the coming Monday. Subsequently, the chamber may announce the judgment.
