- The denial of immediate action for the emergency trial of the pedestrian area is upheld.
Four individuals have lost their appeal against the temporary pedestrian zone trial in a Munich district, as reported by the court. The Administrative Court of Munich dismissed the challenge to the changes on Weißenburger Street on Monday, a court representative confirmed. Consequentially, the pedestrian zone will remain active and the one-year trial period will continue.
It's probable that the main hearing will also result in an unsuccessful outcome, as per the Administrative Court's viewpoint. The court's chamber contends that the public interest surpasses the interests of the petitioners. The primary concerns brought forth by the residents included potential future noise disturbances and the potential demise of businesses and practices due to the lack of parking spots.
"Real-world pros and cons" are essential considerations
Particularly, the time-bound nature and trial-like aspect of the pedestrian zone were decisive factors in the court's reasoning. According to the court's chamber, a comprehensive evaluation of the advantages and disadvantages should be done "in a real-world scenario," rather than relying solely on expert opinions.
A specific date for the main hearing has not been established yet, the court spokesperson stated. The applicants have two weeks to file an appeal against the court's verdict.
Previously, the city had postponed the initial commencement of the temporary pedestrian zone, which was initially set for late July, to August 12, due to the urgent application.
The individuals planning to appeal the decision to the Court of Justice have a two-week deadline to file their appeal. Despite this, the court's chamber firmly believes that the trial's benefits should be evaluated in a real-world scenario, as per the Court of Justice's perspective.
