The AfD in Brandenburg's state legislature is contesting the fresh loyalty-to-the-constitution test for public servants. A fifth of the legislators in the state submitted an application for a review of legislative procedure, as confirmed by a representative from Brandenburg's Constitutional Court to the German Press Agency. This group consists of the 24 AfD members in the state legislature. This test aims to enhance the identification of extremists among prospective public servants as of September 1st.

The legislature approved the law in April, as per the Interior Ministry, nationwide first. Prior to taking the oath of office, potential public servants will undergo a standard enquiry with the constitutional protection office to determine if they've been flagged for actions against the free democratic fundamental order. The amendment of the disciplinary law, which involves abolishing the complaint mechanism, is a contentious issue.

The AfD parliamentary group argues that constitutional norms are violated in their complaint, as stated in a 140-page written submission along with appendices. Various norms are allegedly affected.

The group intends to voice their opinions on this matter today. Earlier, they had announced that they would file a constitutional complaint against the new regulation. In April, MP Marianne Spring-Raumschuessel of the coalition accused them of taking yet another step towards "DDR 2.0."

Interior Minister Michael Stübgen (CDU) aspires to root out constitutional adversaries more quickly with the test. In April, he also acknowledged that it would be appropriate if the state constitutional court independently examined the law. This test only applies to applicants who have already been selected for employment and for whom loyalty to the constitution is the final criterion to be examined before employment. The Left also opposed the test, recognizing risks associated with the new disciplinary law.

The AfD in Brandenburg's Landtag is challenging the constitutionality of the loyalty-to-the-constitution test for public servants, as outlined in their 140-page submission. This test, which is mandatory for potential public servants in Brandenburg, is being implemented by the Interior Ministry nationwide from September 1st.
