A case concerning an attempted homicide utilizing a box cutter necessitates a retrial at the Hamburg Higher Regional Court.

- The accused will offer testimony regarding their endeavor to commit murder using a utility knife.

During the retrial of the alleged attempted murder case that occurred in December 2020 with a box cutter, the defendant's lawyer announced that they would draft a statement. The attorney mentioned this at the onset of the trial in the Hamburg Regional Court. At the initial trial, the Polish defendant had maintained he couldn't recall the incident. Prior to his statement, the judge urged confession if the charges were genuine, stating, "Confession carries the most significant mitigation. It holds the most weight."

The defendant is accused of attempting to slash another man's neck during New Year's Eve 2020 in the Hausbruch district. However, the targeted 25-year-old man skillfully swerved and held onto the defendant's hand, resulting in a 4-centimeter gash on his chin.

In the first trial, the defendant was acquitted in December 2022 due to questions about his involvement. A psychiatric specialist claimed that the defendant may have deemed his opponent as evil due to alcohol and substance abuse.

The verdict was reversed upon appeal by the prosecution by the Federal Court of Justice. The judges argued that the assumption of insanity was not valid in legal terms. The regional court was stated to have not sufficiently examined the situation beyond the expert's conclusions.

The defendant's lawyer expressed regret during the retrial, stating that the defendant had been "misunderstood" during the initial trial, implying he didn't truly "murder" anyone. Despite his acquittal, the prosecution argued that the defendant's actions were severe enough to warrant a conviction, as he "attempted to murder" his victim during New Year's Eve 2020.
