Attempted manslaughter - Stabbing in the back: Seven years in prison for 39-year-old man

A 39-year-old man has been sentenced to seven years in prison for stabbing a man in the back with a knife during an argument. The Hamburg district court convicted the Turkish man of attempted manslaughter in conjunction with grievous bodily harm, a court spokesman said on Tuesday in Hamburg. The victim was also awarded 5000 euros in compensation for pain and suffering. The public prosecutor's office had previously demanded a prison sentence of eight years, while the defense had requested an acquittal.

In March of this year, the 39-year-old had first hit a then 22-year-old with a beer can in a park in Hamburg-Dulsberg during an argument and then stabbed him in the back with a knife "in a swinging motion". What the argument was about remained unclear, according to the spokesman.

The accused had not denied the stabbing in his statement. However, he had claimed that he had acted in self-defense. The chamber did not consider this to be proven. The victim suffered a ten centimeter deep stab wound and a life-threatening injury to his lungs. The verdict is not yet final.

The 39-year-old, who hails from Hamburg, was charged with attempted manslaughter due to the knife thrust, as his actions led to bodily injury for the victim. The public prosecutor argued for an eight-year sentence, acknowledging the severity of the criminal act and the ongoing judicial processes. Despite claiming self-defense, the court found no evidence to support this, leading to the conviction.
