Right-wing extremism - Shot through apartment door: Seven years in prison for attempted murder

The Hamburg District Court has sentenced a defendant to seven years in prison for attempted murder with racist motives. The criminal court was convinced that the German shot through the closed door of his Pakistani neighbor's apartment in Hamburg-Niendorf with a bolt-action rifle on May 27 of this year. The presiding judge, Jessica Koerner, said on Thursday that his intention was not directed against a specific person, but against any person present in the apartment. The chamber also found the 49-year-old defendant guilty of carrying a firearm and ammunition without a permit and of damaging property.

The court thus fell slightly short of the prosecutor's demand for eight years in prison. A maximum of five years, as requested by the defence lawyer, would have been too little due to the presence of two murder characteristics - the trivialization of the crime by the accused and his mindset, said Koerner. There was at least a conditional intent to kill - but there was no reliable evidence of an intent to kill. However, the accused had at least accepted that the pregnant neighbor or another person would be hit by the shot.

In view of a bundle of motives consisting of xenophobia, personal frustration and pent-up potential for aggression, low motives were given. Contrary to his claim, the 49-year-old had never distanced himself from his racist ideas. On the contrary, he had made racist remarks in video recordings shortly before the crime. In addition, the murder characteristic of malice aforethought was present - the accused had attacked his 25-year-old neighbor in a protected space - her own home. The verdict is not yet final.
