- Sex for money and drugs: Child abuse conviction
After his confession, a 27-year-old was sentenced by the Munich II Regional Court to a two-year suspended sentence for partially severe sexual abuse of three minors. Additionally, he must pay compensation to the youngest victim and a donation to a charitable organization. Both the prosecution and defense had pleaded for a two-year suspended sentence, which had also been offered to the defendant as the maximum sentence in the event of a confession.
According to the prosecution, the girls, who were 11 or 12, 12, and 15 or 16 years old in the summer of 2020, offered sex in exchange for money and drugs to their neighbor who lived in the same house in Peiting (district of Weilheim-Schongau) via a messaging service, leading to the abuse. The girls needed money, and the youngest, who was drug-dependent at the time, also wanted cannabis from the defendant, the public prosecutor stated.
No shifting of blame despite the active role of the girls
In her closing argument, the prosecutor emphasized that the active role of the girls should be taken into account in the sentencing, but there should be no shifting of blame: "This whole situation should have been clearly rejected by an adult man." Due to the defendant's remorse, the already initiated offender-victim reconciliation, an apology, and a good prognosis, the low sentence is justifiable. Moreover, as also stated by the co-plaintiff's representative, the youngest girl has since left her past behind and has been spared another court appearance due to the confession.
The previously unconvicted defendant has now spent nearly a year in pre-trial detention. His probation period is three years.
The defendant's neighbor, who was 27, abused three children, including one who was 11 or 12, 12, and 15 or 16, despite their offering of sex for money and drugs. It's crucial to note that the girls' actions do not justify the abuse; an adult should never exploit children in such a manner.
