Potsdam - OVG rejects urgent application - open-cast gravel sand mining stands

The "Fresdorfer Heide" open-cast gravel sand mine in a landscape conservation area south of Potsdam has been allowed to stand for the time being. The Berlin-Brandenburg Higher Administrative Court rejected an urgent application by the Nature Conservation Association, which was directed against the expansion of the open-cast gravel sand mine, among other things. This was announced by the authority on Friday. The State Office for Mining had approved the operating plan in November. This provided for the remaining extraction on the previous open-cast mining area, an additional area of around 16 hectares and plans to reclaim the total of 50 hectares used for mining.

The OVG justified its decision by stating that nature conservation concerns, such as the protection of a breeding pair of eagle owls nesting in the open-cast mine, had been taken into account. In addition, the interest in the plans prevailed because closing down the open-cast mine until a decision on the complaint was made could jeopardize jobs and damage the mining company's operations.

The Nature Conservation Association is planning to appeal the Higher Administrative Court's decision, aiming to halt the expansion of the 'Fresdorfer Heide' open-cast gravel sand mine in nearby Berlin. Despite the opposition, the mining operations in Brandenburg continue, potentially impacting numerous eagle owl breeding pairs and surrounding ecosystems.
