OVG Berlin-Brandenburg: Expropriation of Russian author's work legally enforceable immediately

The Administrative Court confirmed the decision of the Berlin Administrative Court in an expedited procedure. The Berlin Administrative Court had stated that Sergijenko had obtained the granting of German citizenship through deceit. The Berlin Senate Department for Interior and Sport had previously revoked the naturalization.

During an entry from Russia in April 2023, besides a larger amount of cash, a Russian passport was also found on Sergijenko, the Administrative Court stated. In weighing his private interests against the public interest, the public interest prevailed.

An appeal against the expedited decision cannot be filed anymore. According to the Administrative Court, the complaint in the main proceedings is still with the Administrative Court and has not been decided yet.

  1. The challenge against the Constitutional Protection Agency's involvement in Sergijenko's denaturalization process, initiated by the Alternative for Germany (AfD), is currently being examined by the Administrative Court in Berlin-Brandenburg.
  2. The author of a recent article in a German newspaper argues that the constitutional right to protection of one's honor and reputation may be violated due to the publicity surrounding Sergijenko's case.
  3. Following the denaturalization, Sergijenko has expressed his intention to bring a case to the European Court of Human Rights, challenging the decision made by both the Berlin and Administrative Courts.
  4. Despite the ongoing legal proceedings, Sergijenko has been officially banned from entering Berlin, as per the order issued by the Administrative Court in Berlin.
