Middle East conflict - Over 80 proceedings at the public prosecutor's office after terrorist attack

Two months after the terrorist attack by Islamist Hamas on Israel, the Berlin public prosecutor's office has more than 80 cases in connection with it. In 16 cases (as of December 7), these relate to criminal offenses during demonstrations on the intensified Middle East conflict, as a spokesperson for the public prosecutor's office announced on request. According to the information provided, the other 67 cases often relate to anti-Semitic incidents.

The public prosecutor's office is investigating incitement to hatred, depictions of violence, rewarding and condoning criminal acts and the use of symbols of unconstitutional or terrorist organizations, among other things. In total, there are currently around 60 suspects who are known by name.

After the terrorist attack on October 7, the Rias network's reporting offices registered almost 1,000 anti-Semitic incidents within four weeks. In Berlin alone, there were 282 such acts.

There have also been numerous rallies and demonstrations, particularly by the pro-Palestinian community. In the past few weeks, there have been repeated clashes with the police and acts of violence.

The majority of the cases are still with the police, where they are being processed by the state security department responsible for politically motivated crimes. According to the public prosecutor's office, 1684 cases have been registered there so far (as of December 6). This includes 517 cases of damage to property, such as painted or spray-painted slogans. There are 380 cases of violent crime, including 68 reported assaults. However, this also includes acts of resistance against police officers at demonstrations (216). There were 81 cases of breach of the peace and 206 cases of incitement to hatred.

According to the public prosecutor's office, it intends to increasingly examine the possibility of accelerated proceedings in the prosecution of criminal offenses.

So far, however, there has only been one conviction: in mid-November, the Tiergarten district court found a 25-year-old guilty of aggravated breach of the peace, attempted grievous bodily harm and assault on law enforcement officers. The court sentenced the Italian to a suspended eight-month prison sentence because he had been involved in riots at a pro-Palestinian demonstration in Berlin-Neukölln a month earlier.
