Observation of the Office for the Protection of the Constitution: AfD fails with urgent application
The Baden-Württemberg Office for the Protection of the Constitution may continue to monitor the Southwest AfD as a suspected right-wing extremist until further notice. The Stuttgart Administrative Court rejected an urgent application by the party, a court spokesperson said on Tuesday evening. The AfD state chairmen Markus Frohnmaier and Emil Sänze announced that they would examine the decision for errors and see whether they would go to the next instance in summary proceedings. Regardless of this, the trial in the main case will continue.
In July 2022, the State Office for the Protection of the Constitution declared the AfD state association a suspected object of observation and made this public in a press release. The AfD filed a lawsuit against the observation and the public announcement (case no. 1 K 166/23) and filed an application for interim legal protection (case no. 1 K 167/23).
Despite the rejection of their urgent application by the Stuttgart Administrative Court, the AfD state chairmen plan to examine it for errors and consider appealing in summary proceedings. The ongoing monitoring of the Southwest AfD as a suspected right-wing extremist by the Baden-Württemberg Office for the Protection of the Constitution is contingent upon the outcome of these legal processes under the Constitution, potentially leading to future judgments.
