In Saxony-Anhalt, no applications for community-based marijuana farming have been given the green light yet. As of now, there are ten applications under consideration, but many are lacking necessary details, a representative from the Magdeburg Ministry of Health shared in response to an inquiry. Users can submit their applications to the State Office for Consumer Protection (LAV).
The legal cultivation of marijuana plants has been legally allowed in Germany since early July. This was followed by the release of a penalty schedule in the ministerial gazette, which took effect on July 22. Prime emphasis is placed on safeguarding children and adolescents. Fines up to €500 may be imposed if marijuana use takes place in designated prohibited areas such as near schools, daycare centers, public facilities for sports, or children's playgrounds. Potential fines of up to €1,000 may be levied for misuse in close proximity to minors.
Those individuals who promote marijuana or cultivation collectives or participate in sponsorship activities are liable to fines of up to €30,000. The Ministry of Health collaborated closely with Saxony, Thuringia, and Brandenburg in devising the penalty catalog to maintain consistency in enforcement measures across state lines, the spokesperson shared. However, the specific enforcement agencies responsible for implementing these violations have yet to be determined by the cabinet.
In other German states like Saxony, Thuringia, and Brandenburg, similar applications for community-based marijuana farming might be pending, as the federal law allows local jurisdictions to regulate this activity independently. Despite the other states' initiatives, there hasn't been any announcement of approved applications for marijuana farming in these areas yet.
