Neighbor shot: Verdict finds suspect innocent

In a case at the Stuttgart Regional Court on Friday, a man accused of shooting his neighbor is argued by the prosecution to be unsound of mind and should be treated in a psychiatric hospital rather than imprisoned. The man, aged 42, has been diagnosed with paranoid schizophrenia, which led to him targeting his neighbor with threats and insults prior to the incident.

The prosecution shares that the incident occurred in December, where the defendant was allegedly assaulted by his 45-year-old neighbor, causing injuries to his head and hand. His neighbor was accused of destroying the man's motorcycle. As a result, the defendant decided to silence his tormentor once and for all, on the night in question, approaching his neighbor's balcony on the ground floor.

The prosecutor detailed that upon knocking on the railing, the victim went out onto the balcony, and the defendant fired from his double-barreled shotgun, causing a fatal injury. The man also unlawfully possessed the shotgun, along with other weapons and ammunition.

According to German law, punishment can be imposed only if the individual holding an incorrect moral compass and recognizes the injustice of their action. The Criminal Code states that a person is not deemed to be at fault if, at the time of committing the offense, they lacked the knowledge and the ability to control their actions, such as mental health disorders or mental deficiencies.

The defendant insists that he's cognizant of the pain he's caused to his neighbor's family, while the prosecution foresees more potential legal issues due to the man's mental state, as his actions pose a threat to public safety. He was known to have been dealing with paranoid schizophrenia, expressed by hypochondriacal delusions. With these factors in mind, the prosecution maintains that the defendant is a high-risk individual.
