Hesse's Interior Minister, Roman Poseck (CDU), commended the short-term restrictions at all German borders as a substantial move towards greater control over immigration, but also voiced concerns. During a dialogue on internal security in the Wiesbaden state parliament, Poseck stated that the border controls instated by Federal Interior Minister Nancy Faeser (SPD) since September 16 are "a substantial leap forward in controlling migration". However, he expressed reservations regarding the "detention facilities at the borders" proposed by the federal administration.
Poseck highlighted, "It's not straightforward to keep people there, either from a practical or legal standpoint." These detention facilities necessitate a considerable amount of bureaucratic work and fail to offer the required aid. "We have to put a stop at the border, not after it," Poseck emphasized, a day after the second migration conference of the traffic light government and the Union.
Reversal of refugee trends?
Only through rigorous rejections at the border can we successfully diminish the access of refugees and initiate a reversal in refugee trends. According to Poseck, this route is also legally justifiable. The so-called Dublin procedure evidently isn't functioning effectively. With the Dublin procedure, the liable European country for an asylum application is determined. Frequently, this is the country where the applicants initially entered Europe.
Poseck, instead, proposes relying on national statutes. In accordance with the Basic Law, refugees from safe third nations have no right to asylum, hence their entry should be denied. "An increasing number of renowned attorneys are advocating for the legality of border rejections," the interior minister elucidated, having once served as Hesse's highest judge.
"The path of the stop sign"
Regrettably, the traffic light government ultimately didn't agree to "take the path of the stop sign at the border." Poseck reiterated, "I will continue to argue for this path, for example, within the context of the Interior Ministers' Conference."
