A man was sentenced to three years and ten months in prison by the Landgericht Osnabrück on Thursday for a fatal car accident on Autobahn 33 Bielefeld-Osnabrück. The sentence was a result of reckless manslaughter and unlawfully leaving the scene of the accident. The incident took place in October.
The 30-year-old Romanian defendant was said to be annoyed by a car ahead of him that was driving slowly and overtaking a truck carefully, according to a court representative. First, he honked at the car and followed close behind it.
After passing both the truck and the car, the 30-year-old is thought to have suddenly stopped his vehicle. The court claims that he then drove in the overtaking lane, at about the same height as the other car. In this position, he made a sudden movement to the right with his car, causing the other car to be hit from the side. The car then went over the median strip like a catapult, rolling approximately 100 meters down the embankment. The 32-year-old passenger in the crashed car died in the accident.
The defendant confessed only to flashing his lights and turning on his hazard lights before overtaking, but not to giving way to the other car. However, the court did not accept this testimony, according to the spokesperson.
The prosecution had pushed for a life sentence for murder, while the defense had called for acquittal. The judgment is not yet final.
