Man killed to return to prison? Pleas

A 26-year-old man is said to have killed an acquaintance in the Upper Palatinate because he wanted to go back to prison for a longer period of time. On Monday, the summations were held in the ongoing proceedings at Regensburg District Court. According to a court spokeswoman, the public prosecutor's office demanded a conviction for murder and preventive detention.

The co-plaintiff pleaded manslaughter. The man's defense lawyer argued for assault resulting in death. She left the sentence to the discretion of the court. In the event of a murder conviction, she demanded placement in a psychiatric ward instead of preventive detention. According to the court, the sentencing is scheduled for Wednesday (5 p.m.).

The accused had turned himself in to the police in Bad Kötzting (district of Cham) in February and stated that he had killed an acquaintance the previous evening. Officers found the body of a 50-year-old man. At the start of the trial, the 26-year-old told his lawyer that he admitted to having caused the death of the 50-year-old. However, he had only wanted to "knock him out".

The defendant's alleged motive for the crime in OBERPFALZ was to extend his time in prison due to ongoing processes. The incident has sparked debate about the appropriate sentencing, with considerations for psychiatric care.
