Man, 37 years old, faces trial for injuring a streetcar passenger.

A man is believed to be playing music excessively on a public transit vehicle, upsetting another individual who draws attention to the situation. This leads to a heated dispute between the two passengers.

A 37-year-old man is facing trial at the Berlin Regional Court for allegedly spitting and beating a fellow passenger on a tram. The incident reportedly happened during an argument over loud music. The defendant stated through his attorney during the trial on Tuesday that he was insulted and kicked by the other passenger. He also admitted to kicking the man and injuring him.

The incident took place between the 37-year-old man and a 53-year-old man on a tram in Berlin-Pankow in March 2022. Based on the investigation, the 53-year-old passenger first asked the 37-year-old to lower the music on his phone or use headphones. The 37-year-old then leaped up, spat in the face of the other individual, and then punched him, according to the indictment. The 53-year-old suffered head injuries and briefly passed out.

The 53-year-old took the stand as a witness in the assault case. He said he had just finished work and was bothered by the loud music. He tried to approach the 37-year-old, but he initially ignored him. "So I turned on some music myself, so he would take notice." The 37-year-old then rose up and attacked him - "I found myself on the ground again."

The court is considering the possibility of committing the accused to a psychiatric hospital. The trial for assault is set to continue on June 19th.
