Several lawyers have called for the release of a cancer-stricken defendant from custody in Cologne. The 58-year-old must undergo an operation as soon as possible, the statement said. Nevertheless, his release has been refused.

The man has been on trial at the Düsseldorf Higher Regional Court since June on suspicion of being a member of the terrorist DHKP-C. "The cynical way in which our client's fundamental right to life and health is being dealt with is outrageous," the statement reads. The DHKP-C is a Marxist-Leninist underground organization from Turkey.

The prison where the defendant is being held on remand took 15 months before he was finally able to undergo a biopsy, which finally confirmed the suspected cancer, despite being suspected of having cancer.

"Anyone who thinks they can refer our client to an operation organized by the prison "in the medium term" is irresponsibly gambling with his health and his life." The senate is accepting a worsening of the illness.

A spokeswoman for the Higher Regional Court stated that the senate had based its decision on the recommendations of the treating doctors at Cologne University Hospital and the medical service at Cologne Prison. According to them, release from prison was not necessary for professional medical treatment.

The detention review decision shows that there had indeed been delays in the examination and that the prison doctor had warned that further delays were "no longer justifiable".

In one case, however, the defendant himself was responsible for a delay: he had refused an examination appointment that had been brought forward by almost a month when he learned that his shackles were not to be removed during the examination.
