Parliament - Lawyer Schmidt becomes a judge at the state constitutional court
The state parliament in Schwerin has elected lawyer Alexander Schmidt as a member of the state constitutional court of Mecklenburg-Vorpommern. The 50-year-old lawyer from Neubrandenburg received the necessary two-thirds majority in parliament on Wednesday following a secret ballot. 50 MPs voted for him, two abstained and 18 voted against his appointment. He was already a deputy member of the Constitutional Court in Greifswald and is now moving up to the front row of judges there. Schmidt was born in Greifswald and also studied there.
He succeeds Barbara Borchardt, who died in August at the age of 67. The election of the long-standing member of the state parliament and avowed supporter of the anti-capitalist Left as a judge at the 2020 State Constitutional Court was highly controversial at the time.
Like Borchardt, Schmidt, a lawyer who is primarily active in social law, has now also been nominated for the judgeship in Greifswald by the left-wing parliamentary group. In the relevant state parliament committee, the CDU, Greens and FDP had also signaled their approval in addition to the SPD and Left Party coalition factions. According to the state parliament, the AfD announced that it would vote against the candidate. As the party has 13 members in the state parliament, there were also votes against from other parliamentary groups.
Carl-Henning Clodius, a lawyer working in Rostock, was elected as the new deputy member of the state constitutional court at the suggestion of the FDP. He received 59 votes in favor, eight against and three abstentions.
Alongside the state parliament and the state government, the Constitutional Court is one of the constitutional bodies of the state of Mecklenburg-Vorpommern. It is also part of the judiciary and decides on issues relating to the application and interpretation of the state constitution. Its decisions are binding.
