German League 2 - Lawsuit victory for Fredi Bobic in Hertha dismissal case
The Berlin District Court has ruled in favor of former Hertha BSC managing director Fredi Bobic in his lawsuit against his dismissal from the club. The court's decision, announced on Tuesday morning, states that Bobic's employment contract was not terminated by extraordinary dismissal on February 10, 2023. However, an appeal can be filed. The reasoning behind the judgment has not been disclosed.
If the judgment becomes final, Bobic will be entitled to the contractually agreed compensation from the financially struggling second-tier football club. Bobic had filed a lawsuit against both his ordinary and extraordinary dismissals, which occurred in early 2023. He was forced to leave after the derby against Union Berlin at the end of January, and was later dismissed extraordinarily. The court previously dismissed the lawsuit against the ordinary dismissal in a partial ruling in February of the same year.
Hertha used Bobic's handling of a reporter and suspected him of sharing confidential documents as grounds for the extraordinary dismissal. In his statement during the oral hearing on Monday, Bobic and witness Axel Hellmann, the managing director of Eintracht Frankfurt and interim managing director of the German Football League (DFL) at the time, both denied the allegation of passing on confidential information.
However, this contradicts a sworn statement by former Hertha president Kay Bernstein from September 2023, which was submitted to the court. Bernstein, who passed away suddenly in January 2024, confirmed in a conversation with Hellmann that he had received a data sheet on the cooperation between Hertha and investor 777 Partners from Bobic.
